These Terms and Conditions (the “Terms”) constitute a legally binding agreement between you (the “User” or “you”) and Hash Pay Sp. z o.o., a company registered in Poland with its registered address at ul. Stanisława Przybyszewskiego 91-99, m. 15, 93-126, Łódź, Poland (“BetterHash,” “we,” “us,” or “our”), regarding your access to and use of the BetterHash platform, website, application, services, products, and associated features (collectively, the “Platform” or “Services”).

 

By accessing, browsing, or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the Platform.

 

 

  1. Definitions

 

Unless otherwise stated, capitalized terms used in these Terms shall have the following meanings:

 

“Account”: A registered account maintained by a User on the Platform.

“Applicable Law”: Any national, local, or international statute, regulation, rule, order, decree, directive, or guideline in effect from time to time.

“Digital Assets”: Cryptographic tokens, cryptocurrencies, digital coins, and other blockchain-based assets supported by BetterHash.

“Fiat Currency”: Government-issued currency that is designated as legal tender, including but not limited to EUR, USD, and PLN.

“KYC”: Know Your Customer procedures aimed at verifying the identity of Users.

“AML”: Anti-Money Laundering.

 

 

  1. Eligibility

 

By using the Platform, you represent and warrant that:

– You are at least 18 years of age and have full legal capacity to enter into and comply with these Terms;

– You are not a citizen or resident of a jurisdiction where use of the Platform is prohibited by law;

– You are not listed on any sanctions list, including but not limited to those maintained by the EU, UN, OFAC, or other relevant regulatory authorities;

– Your use of the Platform does not violate any Applicable Law.

 

 

  1. Account Registration and Security

 

3.1 Account Setup: To access certain Services, you must register and maintain an Account by providing accurate and complete information. Failure to do so may result in the suspension or termination of your Account.

 

3.2 Account Security: You are solely responsible for safeguarding your login credentials. BetterHash will not be liable for any loss or damage resulting from unauthorized access to your Account.

 

3.3 KYC & Verification: For transactions exceeding €1000 or as otherwise required by Applicable Law, Users must complete KYC verification. Before this threshold, Users must provide full name, email address, and phone number.

 

3.4 Suspension and Termination: We reserve the right to suspend or terminate your Account at our sole discretion, particularly in cases of suspected fraud, breach of these Terms, or as required by law.

 

 

  1. Services Offered

 

BetterHash provides access to the following services:

– Digital Asset exchange (fiat-to-crypto, crypto-to-fiat);

– Digital Wallet services for storing supported assets;

– Secure and instant transaction services;

– Market analytics, trading tools, and real-time data.

 

We may modify, enhance, or discontinue any of the Services at our sole discretion and without liability.

 

 

  1. User Responsibilities

 

You agree to:

– Use the Platform only for lawful purposes;

– Maintain the confidentiality and security of your Account credentials;

– Promptly notify us of any unauthorized use of your Account;

– Provide accurate information for KYC and ongoing compliance.

 

You must not:

– Engage in illegal activities such as fraud, money laundering, or financing of terrorism;

– Interfere with or disrupt the Platform;

– Transmit viruses or any code of a destructive nature.

 

  1. Fees

 

Fees for all transactions and services are displayed transparently on the Platform. By using the Services, you agree to pay all applicable fees. BetterHash reserves the right to revise its fee structure at any time, with changes published on the Platform.

 

  1. Risk Disclosure

 

Trading and holding Digital Assets involve substantial risk, including price volatility and the risk of total loss. By using the Platform, you acknowledge and accept that:

– BetterHash does not offer investment advice;

– The value of Digital Assets can fluctuate significantly;

– You trade and transact at your own risk;

– BetterHash is not liable for losses arising from your use of the Platform.

 

 

  1. AML / KYC Compliance

 

BetterHash adheres strictly to AML/CTF obligations and implements KYC procedures in line with Polish and EU regulations. Users must provide information and documentation as required. We reserve the right to:

– Refuse to open an Account;

– Suspend or terminate existing Accounts;

– Report suspicious activities to competent authorities.

 

 

  1. Intellectual Property

 

 

All content, software, design elements, logos, trademarks, and data on the Platform are the exclusive property of BetterHash or its licensors. You are not permitted to reproduce, republish, or exploit any part of the Platform without our express written consent.

 

 

  1. Limitation of Liability

 

 

To the maximum extent permitted by law:

– BetterHash shall not be liable for any indirect, incidental, consequential, or punitive damages;

– Our total liability shall not exceed the total amount of fees paid by you to BetterHash in the preceding 12 months;

– We provide the Platform on an “as is” and “as available” basis without warranties of any kind.

 

 

  1. Indemnfication

 

 

You agree to indemnify, defend, and hold harmless BetterHash, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your breach of these Terms, misuse of the Platform, or violation of Applicable Law.

 

 

  1. Termination

 

 

BetterHash reserves the right to:

– Suspend or terminate your access to the Platform at any time without prior notice;

– Close your Account and return any remaining Digital Assets, subject to legal obligations.

 

You may also terminate your use of the Services by closing your Account. Upon termination, these Terms shall continue to apply to any obligations incurred prior to termination.

 

 

  1. Changes to Terms

 

We may amend these Terms from time to time. Updated Terms will be posted on the Platform with an updated effective date. Your continued use of the Services following such changes constitutes your acceptance of the revised Terms.

 

 

  1. Governing Low and Dispute Resolution

 

 

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Łódź, Poland.
